Abortion Doctor’s Lawyers Seek Dismissal Of Charges « CBS Baltimore: Dr. Steven Brigham lost his New Jersey medical license in 2010 after regulators discovered an arrangement under which he would begin second- and third-trimester abortions in New Jersey, and then have the patients drive themselves to Maryland the next day to complete the procedures.

His attorneys argued in a motion filed last week that the arrangement protects him from criminal prosecution in Maryland because Brigham administered drugs that killed the fetuses while the patients were in New Jersey. He then extracted the fetuses at his clinic in Elkton, Md., a small town in the northeast corner of the state.

Brigham’s lawyers also argue that he is immune from prosecution under Maryland’s fetal homicide law, which was intended to apply to people who kill or do physical harm to pregnant women, causing fetal death. The law includes exemptions for physicians administering lawful medical care, and Brigham’s attorneys say using it against an abortion doctor interferes with a woman’s constitutional right to terminate a pregnancy.

City repeals, replaces sign ordinance for pregnancy centers: The Austin City Council repealed an ordinance Thursday that requires some centers that counsel women with unplanned pregnancies to post entrance signs saying they don't offer or refer clients to abortion or birth control services.

The council replaced it with a new, similar ordinance that omits "abortion" and "birth control" from the signs and instead requires the centers to say on the signs whether they offer medical services under the direction of a licensed health care provider.

The four Austin centers that were subject to the original ordinance sued the city over the ordinance last year , saying it violated their constitutional rights and targeted them for their Christian views against abortion and contraception.

Attorneys for the centers said Thursday that the new wording still unfairly singles out their clients and that they plan to proceed with their lawsuit.

According to public record documents obtained by AbortionDocs.org, Levy paid out $20,000 last year in a case alleging his negligence in the death of a patient during a botched abortion in 2007. In 2007, Levy paid out a whopping $6 million to settle a 1995 case brought by the family of a brain-damaged child who suffered injuries as the result of Levy’s misinterpretation of ultrasound findings.

In 2004, Levy settled a personal injury case for $7,500 after he allegedly inflicted second and third degree burns to a patient’s private organs by inserting a hot weighted speculum during surgery.

In spite of all this, Levy has never been disciplined by medical regulators. In fact, he continues to train abortion practitioners at the University Medical Center in Las Vegas.

The rash of articles were all tied to a blatant piece of propaganda published in Obstetrics and Gynecology by Dr. David Grimes, an abortion provider and chief propagandist for “medical proof” of abortion’s safety.

The new study repeats the same discredited practice of simply comparing nationally reported maternal mortality rates with Center for Disease Control (CDC) reported deaths associated with abortion. Sounds reasonable, until you learn that there is no accurate or formal mechanism for reporting abortion-related deaths. Indeed, the rules regarding completion of death certificates specifically exclude identifying abortion as a cause of death.

At least in part, this is why CDC officials have admitted that maternal mortality rates and abortion mortality rates “are conceptually different and are used by the CDC for different public health purposes.” In other words, the CDC numbers on abortion-related deaths cannot be meaningfully compared to maternal mortality rates.

National Right to Life: Did you know that in our nation's capital, unborn children daily are subjected to terribly painful deaths, even during the sixth and seventh months of pregnancy, or even later? Did you know that these practices are perfectly legal -- because in the District of Columbia, abortion is now legal at any point in pregnancy, for any reason, as long as someone is willing to pay the abortionist for the gruesome "service"?

One abortion "clinic," situated not far from the Capitol Mall and the White House, openly advertises abortion on demand up to the beginning of the seventh month of pregnancy -- payable by a credit card. ("Checks and money orders are not accepted.") This facility mentions the method used for its late abortions -- "dilatation and evacuation," also known as "dilation and evacuation" or "D&E." However, they do not explain that in a D&E -- shown in this medical illustration -- the abortionist grasps the little arms and legs of the well-developed unborn baby and literally tears them off, one by one, by brute manual force.

Another abortionist advertises abortions "in Washington, D.C.," even in the seventh and eighth months. He describes using a different method -- employing ultrasound while thrusting a needle into the heart of the unborn child, and then injecting a lethal substance (either air, or a drug). This "service," he advises, is "not inexpensive," and that "payment can only be made by a bank electronic transfer."

LifeSiteNews: Pro-life doctors say that, because [the study on the relative safety of abortion and childbirth] fails to include the long-term adverse effects of abortions, the years-old claim that abortion’s mortality rate is lower misrepresents the overall effects of abortion on women versus bringing a child to term.

“[Abortion] is not safe when you look into the long term,” Dr. Mary Davenport, president of the American Association of Pro-Life OB/GYNs, told LifeSiteNews.com. “They were only talking about immediate death. If you do the math, there is a much higher rate of risk-taking behaviors,” including suicide attempts and substance abuse, said Davenport.

Microbiologist and bioethics commentator Gerard Nadal told LSN that such data fails to account for the physical damage often sustained by women during abortions, including damage to reproductive organs that has been strongly linked to subsequent pregnancy complications or even sterility. Meanwhile, he said, abortion’s link to increased risk of breast cancer, and childbirth’s protective effect against cancer, is ignored.

Another OB/GYN, Dr. Matt Phillips of CEC For Life, agreed, saying the study’s claim is “at least 20 years old” and based on skewed information. “You can make the numbers look any way you want to make them,” he said.

Louisiana responds to request for abortion files

The Advocate: On the eve of a massive march against abortion through downtown Baton Rouge streets, the state health chief promised Friday to enforce a legal requirement that physicians who perform pregnancy terminations properly fill out the mandatory forms.

. . . State Department of Health and Hospitals Secretary Bruce Greenstein on Friday met with representatives of 20 anti-abortion advocates who had filed public records requests seeking disclosure of about three decades worth of Reports of Induced Termination of Pregnancy.

Physicians are required by law to fill out a form for each procedure they perform. The reports are supposed to document 25 specific pieces of information about the woman and her pregnancy, how the procedure went and any complications.

Mike Johnson, a Shreveport lawyer, said the advocates he is helping suspect that many physicians over many years filled out the forms in advance and did not accurately portray what happened before, during and after the abortion. The state had either not noticed or ignored the improperly filed forms that are supposed to provide statistics used to set health-care policies, he said.

The goal of the public records requests was to press the Jindal administration to enforce the state law that levies penalties on physicians who fail to properly complete the forms, Johnson said.

IL cracks down on abortion clinics

An increased scrutiny of Illinois abortion clinics in the wake of revelations about a "house of horrors" in Philadelphia revealed that some facilities had gone up to 15 years without inspections, and two now have closed after regulators found health and safety violations. The renewed oversight by state regulators led to the permanent closure of a clinic in Rockford earlier this month, following the closing of a clinic in suburban Chicago last October, according to documents obtained by The Associated Press through a Freedom of Information Act request.

One of those facilities — the Women's Aid Clinic in Lincolnwood — closed when the owner decided to surrender its license rather than pay a $36,000 fine or endure an expensive legal fight with the state. The fine was for violations including the clinic's failure to perform CPR on a patient who died after a procedure. Its owner told the AP her clinic was safe and she felt victimized by the surprise inspection after 15 years.

While Illinois is working on the backlog of neglected inspections, the documents reviewed by the AP show that a few abortion clinics in the state still haven't been checked in more than a decade. One in Chicago hasn't been inspected in 16 years. Another in the suburb of Wood Dale was last inspected nearly 15 years ago.

State officials attribute the lag to a lack of funds and resources, noting that the state's 24 trained health inspectors are responsible for inspecting nearly 2,000 facilities.

In 2011, Illinois inspectors visited all nine licensed abortion clinics that are defined as pregnancy termination centers, a category that limits them to first-trimester abortions and no other procedures. . . . The inspection sweep of the nine clinics didn't include other centers that perform more services than first-trimester abortions and are classified as ambulatory surgery centers. Anti-abortion groups said there are four such centers. . . . Illinois law doesn't specify how frequently either type of abortion clinic must be inspected. Both kinds must renew their licenses annually, but no inspection is required with that. . . . A third type of health facility providing abortions isn't licensed or inspected in Illinois. These clinics are considered to be similar to doctors' offices, which aren't licensed by the state, and the majority of their services aren't surgical procedures. Planned Parenthood clinics fall into this category.

. . . Sharon Levin, vice president of the National Abortion Federation, a standard-setting body for providers, said the Philadelphia case is unusual and shouldn't be used as a basis for a crackdown. State regulators should inspect abortion clinics as often as they do other similar medical facilities, Levin said, but 15 years between inspections is excessive. "We have clinical policy guidelines and we regularly inspect our members ..." she said, "but we would consider 15 years too long." On Friday, Casey said the teen, who is about 10 weeks pregnant, wants to carry her child to term. She has not finalized her decision, whether it's adoption or parenting the child.

Abortion rates have exploded since the economic collapse, she warned, as nearly three-quarters of women ending their pregnancies say they simply can’t afford to have a baby. Hoffman expanded on that trend to forecast a “dim future” for women if a Republican wins the White House: a world of abortion “slave states” and “underground railroads” and “pre-Roe reality.”

There was just one problem with this hysteria: The data in the study she presented were from 2008 — before the impact of the recession was felt. . . .
If the “choice” rally participants really wanted to preserve legal abortion, they’d be wise to drop the sky-is-falling warnings about Roe and to acknowledge that the other side, and most Americans, have legitimate concerns. Not every compromise means a slippery slope to the back alley.

But this is no time for reason; this is time for collecting donations. At the Press Club, abortion provider Hoffman gave a full-throated defense of her own abortion (“I had committed myself to my work” and didn’t want to be “diverted”), coupled with dire warnings about the future of legal abortion (“relentless attacks . . . will be impossible”). Hoffman likened her defense of the procedure to Martin Luther’s 95 Theses. “Abortion is a life-affirming act,” she said, and “abortion is often the most moral choice.”

CTV sting operation tries to catch crisis pregnancy centre giving misinformation | LifeSiteNews.com: On December 15th, 2011, CTV News in British Columbia launched a sting operation against the South Fraser Pregnancy Options Centre in Surrey, BC, with the what Executive Director Laura Lansink said was “the hope that our peer-counselor would give false or biased information.”

The Pregnancy Options centres are associated with the Canadian Association of Pregnancy Support Services (CAPSS), a national, non-political, registered Christian charity, committed to equipping pregnancy support services.

Jon Woodward of CTV News called the Centre, saying that he had received a ‘complaint’ from a client who believed the Centre had given her false medical information regarding the risks of abortion.

In a subsequent phone call he admitted this person had been sent from CTV News to the Centre with a hidden camera with the intent of exposing the organization for providing supposedly false information.

Decision blasts judge’s order to force abortion - BostonHerald.com: In a December hearing, the Department of Mental Health applied for temporary guardianship for the parents of the 32-year-old woman — referred to as “Mary Moe” — to let them consent to an abortion for their daughter, who already had one child currently in their care.

Harms approved guardianship, ruling Moe could be “‘coaxed, bribed, or even enticed ... by ruse’ into a hospital where she would be sedated and an abortion performed,” the appellate ruling states. “Additionally ... and without notice, the judge directed that any medical facility that performed the abortion also sterilize Moe at the same time to avoid this painful situation from recurring.”

The decision notes that Moe, when asked whether she would have an abortion, told Harms she “wouldn’t do that,” but that based on her “substantial delusional beliefs,” Harms found Moe incompetent to make a decision.

An appeals court overturned the decision.
