New law to be used in capital murder case | montgomeryadvertiser.com | Montgomery Advertiser: A capital murder case in volving a pregnant woman will give Montgomery County prose cutors an opportunity to use a relatively new law that allows a murder charge to be filed in the death of an unborn child. The district attorney's office will seek the death penalty in the stabbing death of 34-year-old Kimberly Lewis and her 4-month-old fetus. Because of a change in Alabama law in 2006, the fatal stabbing quali fies as capital murder because two people were killed as a re sult of the stabbing.
